Can I appeal if my application was denied by USCIS?
- Many USCIS denial notices state that you cannot appeal the decision. But, many times, you may file a motion to reopen or reconsider instead.
- If you cannot appeal, or if you do not want to appeal or file a motion, you may file a new application for the same benefit.
- If your application or petition was denied, you should consult with an experienced attorney to find out what options make the most sense in your particular case.
- Strict deadlines exist for appeals and motions based on denials by USCIS. If you miss the deadline, you may be without any viable options moving forward.
Can I appeal if my case immigration court case was denied?
- Almost all denials by immigration judge may be appealed to the Board of Immigration Appeals (BIA). The appeal must be received by the BIA on time. No extensions can be granted.
- There is only one immigration appellate court within EOIR. That court, the BIA, decides all immigration court appeals in the U.S.
- If you lose your case at the BIA, you may be eligible to file an appeal in a U.S. Circuit Court.
- There are many circuit courts in the U.S. The way the law is interpreted and applied in the United States varies depending on where you live.
