What is Temporary Protected Status (TPS)?
- TPS or temporary protected status is a benefit that protects an individual from deportation for a set period. TPS holders cannot be physically removed from the United States for the duration of time that they hold TPS.
- TPS also allows an individual to apply to work lawfully in the United States.
- TPS also may allow an individual to travel outside of the United States if they are issued an advance parole document.
- TPS does not lead to lawful permanent residency or any other status by itself. For example, someone married to a TPS holder would still have to petition their spouse for residency.
- TPS was created to protect people already present in the U.S. from deportation to a place where, for example, tragedy has occurred, such as a natural disaster.
Who qualifies for Temporary Protected Status?
- Individuals from certain designated countries may be eligible to apply for TPS benefits.
- TPS is designated for certain countries for a set period of time, and the list of eligible countries changes as the government decides which countries to add or remove from the TPS program.
- TPS always requires physical presence in the U.S. on and from a certain date, and this date varies by country.
- Individuals with criminal history may not qualify for TPS, depending on the type of conviction and how many criminal convictions he or she has.
How long does TPS last?
- The initial designation for a country is generally 18 months, but is subject to extension by the U.S. government.
- If the designation period is extended, an individual can re-register for TPS in periods designated by the government if they remain eligible. This allows them to renew their work permit.
